Who this applies to

This Privacy Policy explains how 2510647 Alberta Ltd. (O/A ActionCOACH Catalyst) collects, uses, discloses and protects personal information when you interact with our websites, forms, marketing, events and coaching-related enquiries.

We're committed to complying with applicable Canadian privacy laws, including PIPEDA (federal) and, where applicable, provincial private-sector privacy laws (e.g., Alberta PIPA) and Québec's private-sector privacy law (as modernized by Law 25).

1. What we collect

Personal information you choose to provide, such as: name, email address, phone number; city/province, business name, industry and role; your interests, preferences and coaching/service needs; information you enter in open-text fields (and any documents you upload).

Information collected automatically when you use our sites: IP address, device type, browser type and operating system; site activity data (pages visited, time on site); cookies or similar tracking technologies (see section 7).

2. How we use your information

To respond to enquiries and provide requested information/resources; connect you with a local ActionCOACH coach, franchisee or representative; deliver services you request (including calls, assessments, event registrations); improve our websites, offers and user experience; send marketing communications only where permitted and/or with consent; meet legal and regulatory requirements.

3. Consent and lawful purposes

In Canada, we collect, use and disclose personal information for purposes that a reasonable person would consider appropriate, and we obtain consent when required. Under PIPEDA, knowledge and consent are generally required (subject to limited exceptions).

Marketing messages (email/SMS): we follow Canada's Anti-Spam Legislation (CASL) rules, which generally require consent, identification information and an unsubscribe option in commercial electronic messages.

4. Third-party enquiries (franchisees, licensees, coaches)

ActionCOACH Catalyst may share your information with a local coach/franchisee/licensee when it's necessary to respond to your request or deliver services. In those situations we share only what's reasonably needed for the purpose; the local coach/franchisee may contact you directly; and the local coach/franchisee may be an independent business handling your information under their own privacy practices.

We may also share information with service providers that help us operate (for example, CRM platforms, analytics, email/SMS tools, scheduling tools, cloud hosting). These vendors are required to protect information and use it only to provide services to us. We do not sell your personal information.

5. Retention

We keep personal information only as long as necessary for the purposes described in this Policy, and as required by law. As a general guideline, enquiry records may be retained for up to 12 months, unless you become an active client, you ask us to keep communicating, or a longer period is required for legal/business reasons.

6. SMS / text messaging

If you choose to opt in to receive SMS/text messages from ActionCOACH Catalyst, we may send you messages related to your enquiry, event registration, appointment reminders, requested resources and (where permitted) promotional or marketing communications. You may opt in by submitting an online form that includes an SMS consent checkbox, requesting to be contacted by text, registering for an event, completing a lead form, or otherwise providing express consent.

Message frequency varies based on your activity. Standard message and data rates may apply. You can opt out at any time by replying STOP; you may receive one final confirmation message. Reply HELP for assistance. Opting in is optional: you can still request information or services by email or phone. We may use third-party SMS providers, who are required to protect your information and use it only to provide services to us.

7. Cookies and tracking

We use cookies and similar technologies to remember preferences and improve site functionality, measure traffic and site performance, and understand which content is helpful. You can manage cookies through your browser settings. Where required, we will request consent for certain cookies.

8. Data security and handling

We use reasonable physical, organizational and technical safeguards to protect personal information against loss, theft and unauthorized access, use or disclosure. Access is limited to authorized staff and approved service providers on a need-to-know basis, and they're required to maintain confidentiality.

9. Your rights

Depending on your province and circumstances, you may have the right to request access to your personal information, request corrections to inaccurate information, withdraw consent (subject to legal/contractual restrictions), and ask questions or make a privacy complaint.

Québec residents: Québec's private-sector privacy law includes additional rights, including a data portability right for certain computerized personal information (in force since September 22, 2024).

10. Mobile information sharing

Mobile information is shared only with service providers that help us send texts (SMS platforms/CRM providers), strictly to deliver and manage messages on our behalf; with a local coach/franchisee when you ask to be contacted by a specific coach; or if required by law. Service providers and partners are required to protect your information and use it only to provide the requested services.

11. Changes and contact

We may update this Privacy Policy periodically. Any changes will be posted on this page with the updated effective date.
